Using Touchgasm
Terms of service
Version dated 16 October 2026. You can save or print these terms from your browser.
1. Service provider
Dark Fox Kamil Kmetyk · Biała Góra 107, 97-505 Dobryszyce · NIP 594-159-48-85. Contact for support, complaints and moderation: contact@touchgasm.com. Privacy contact: contact@touchgasm.com.
2. Account and tools
Browsing the library, downloading community packs and using the builder are free. Uploads, ratings and comments require an account with a verified email address. Registering creates an account service agreement; contact us to close your account. Keep your password secure and use the service lawfully.
The site requires a current browser with JavaScript, session cookies and an internet connection. The builder creates ZIP files locally in your browser. Creating or downloading a ZIP from the builder does not publish a pack.
3. App and purchase
Touchgasm requires macOS 13 or later and a supported trackpad. Hardware requirements are described on the home page. The app is a one-time purchase including app updates we release. The total price and currency are shown before purchase; payments are handled by Stripe. Downloads become available in your account after payment confirmation. Community packs remain free regardless of whether you purchase the app.
Consumers retain their statutory rights concerning the conformity of digital content and the right to withdraw from a distance contract within 14 days. You can send your withdrawal by email with your order details. Downloading the app or accepting these terms alone does not waive this right.
4. Sharing your packs
Only upload your own materials or materials whose licence permits public distribution and download as part of a pack. This includes recordings, voices, artwork and all other content. Keep required credits, sources and licences in the manifest. Do not include another person’s private data without a lawful basis. The author name, description, manifest and contents of approved packs will be public.
Uploading a pack does not transfer copyright. You grant us a non-exclusive, royalty-free, worldwide licence to store, technically validate, create thumbnails of, display and distribute the pack for free through the library for as long as it is published. Users may download and play the pack in Touchgasm. Further reuse remains subject to the licences specified by the relevant rights holders; we do not automatically assume a CC0 licence.
You can withdraw a pack under My packs. Withdrawal stops new downloads through the service and ends our publication licence; it does not delete copies already lawfully downloaded by users. Submit an updated version as a new pack for review.
5. Review and moderation
Every pack enters a private review queue. An administrator may publish, reject or unpublish it. We review technical compatibility, the description, NSFW labelling and distribution rights. Automated ZIP validation does not establish copyright ownership or guarantee recording quality. You can see the decision and its reason on your pack page. Publication is not guaranteed.
Do not publish unlawful content, content infringing others’ rights, private data, malicious files, threats, harassment or spam. NSFW content is for adults only and must be labelled; this does not permit content prohibited by law. An administrator may remove comments that violate these rules and provide the author with a reason.
6. Ratings and comments
Each account may give one rating from 1 to 5 stars and change it later. Authors cannot rate their own packs. We show the average of all saved ratings for each pack and the rating count. We do not verify whether a reviewer purchased the app or used the pack; ratings are not labelled as verified purchases. Fake accounts and rating manipulation are prohibited. Comments are public with the account name; you can delete your own comments.
Comments are reviewed by an administrator before publication. Rejected comments and the reasons for rejection are visible to their author and administrators. You can also delete your own comment before approval.
7. Reports, appeals and complaints
Report problems using the link on a pack page or by email. Include the exact URL or identifier of the pack or comment, an explanation of the issue, your contact details and a statement that you are reporting in good faith and believe the information to be accurate. A person reviews reports. We will communicate the outcome; the affected author receives a reason for content restrictions. You can appeal a decision by email, identifying the decision and explaining your reasons.
Send complaints about the service or a purchase to our support address with a description and information identifying the issue. We respond within 14 days. These terms do not limit mandatory consumer rights, access to courts or assistance from consumer protection bodies.
8. Data and changes to these terms
Data processing and cookies are described in the separate documents linked in the footer. We record the version of the terms accepted with each pack submission and the acceptance date. Material changes will be announced on the site in advance; they do not retroactively change purchase rights or the scope of a granted licence without appropriate consent.
